O homem contemporâneo vive um mundo de incertezas, onde muitos dos antigos paradigmas que o senso comum considerava como absolutos se desmoronam com incrível velocidade. Esta volatilidade de sentidos é observada com ampla nitidez na busca do sagrado: as religiões tradicionais são deixadas de lado ou misturadas a práticas esotéricas, místicas e ocultas, tentativa humana de explorar o mundo através de um enfoque holístico, que reimprima na vida a magia outrora perdida. Neste contexto de construção de uma nova realidade, a (...) percepção e manifestação do sagrado não desaparecem, mas, seguindo a mentalidade de seu tempo, transformam-se. A religiosidade assume um caráter individualista, imediatista e descompromissado, restaurando conceitos e práticas da antigüidade, em uma tentativa clara de reencantamento do mundo, agora sob a perspectiva da sociedade globalizada. Filosofias orientais invadem a dimensão religiosa do mundo ocidental, numa mistura explicitamente paradoxal. Deste epicentro nasce a cultura da Nova Era, movimento que busca restaurar a tradição sagrada do homem postulando um saber místico, pretendendo conectar o ser humano ao transcendente partindo não de instituições específicas, mas de conhecimentos e práticas do esoterismo, ocultismo e magia. ABSTRACT Contemporary man lives in a world of uncertainties, where many of the old paradigms that common sense used to consider absolute are falling apart with incredible speed. Such volatility of senses is clearly noticed in the search for the sacred: traditional religions are left behind or mingled with esoteric, mystical and occult practices, in a human attempt to explore the world from a holistic viewpoint capable of rescuing life’s lost magic. In that context of construction of a new reality, the perception and manifestation of the sacred do not disappear; they rather change, following the mentality of the times. Religion assumes an individualistic, immediate and uncommitted feature, restoring old concepts and practices, in an attempt to render the world enchanted once more, now in the perspective of globalized society. Oriental philosophies invade the religion scope of the Western world, in an explicitly paradoxical blend. From that epicenter is born the New Age culture, a movement that tries to restore human sacred tradition by postulating a mystical dimension and connecting man to the transcendent, not through specific institutions, but through the knowledge and practice of esoterism, occultism and magic. La pena natural es una situación paradójica que se puede presentar cuando el autor de un delito, al cometerlo o a causa de éste, ha sufrido un daño igual o mayor al que padecería si el juez de la causa le aplicara la pena estatal prevista para tal conducta. Se da con frecuencia al juzgar ciertos accidentes viales, cuando el acusado ya carga el peso de ser quien, por imprudencia, mató a su pareja o familiar cercano, por ejemplo. Pero ¿en (...) qué situaciones y cómo cabe recurrir a la pena natural? En esta investigación, Manuel Serrano explora las diversas aristas y posturas en pugna que atraviesan este tema, donde se cruzan cuestiones como la idea de la “culpa compensada”, la prohibición de aplicar castigo doble por un mismo hecho (non bis in idem) y la clemencia judicial. El autor desmonta la estructura conceptual de la pena natural, estudia jurisprudencia argentina y recorre producciones teóricas de juristas que se han preocupado por este asunto complejo, profundo y poco abordado del derecho penal. O governo do presidente Fernando Henrique Cardoso teve papel relevante na consolidação de políticas voltadas ao campo e ao processo de reforma agrária no Brasil. O objetivo do artigo é refletir sobre o perfil e as tensões envoltas na política de reforma agrária do governo FHC, e os desdobramentos dessa política face ao número de famílias assentadas e áreas obtidas para fins de reforma agrária no Brasil. Utiliza-se como fonte textos de pesquisadores que estudaram os caminhos e descaminhos da reforma (...) agrária brasileira e dados do “Banco de Dados da Luta Pela Terra”. Compreende-se que, no Governo FHC, apesar do número de famílias assentadas e áreas obtidas terem avançado de forma considerável em relação a governos anteriores, a reforma agrária foi tratada de forma marginal, e o governo, por vezes, negou as lutas e o protagonismo dos movimentos sociais do campo. ¿Qué pasaría si, en el momento fundacional de la modernidad, el personaje principal no fuera el yo cartesiano, sino ese otro personaje que Descartes llamó genio maligno? Esa es la hipótesis que plantea el presente ensayo: ¿qué ocurriría si en lugar de la agotada certeza del yo, el mundo moderno se hubiera asentado más bien sobre la confusión y sobre la trampa que se condensan en la metáfora del genio maligno? Desde esa hipótesis, la mayor parte de las configuraciones filosóficas (...) de eso que llamamos modernidad aparecen transfiguradas, se convierten en meras repeticiones de aquel fraude básico que ocultan. Pero donde tales configuraciones velan ese gesto al repetirlo, el género de terror y los discursos sobre la angustia y la locura parecen haberlo denunciado como grietas de un edificio sin fondo. Este es el viaje apasionante que se propone en este libro, un viaje en el que autores como Poe, Stevenson o Conrad se atreven a proponernos lecturas de Nietzsche, Heidegger o Deleuze y Foucault, en el que personajes como Frankenstein o el doctor Jekyll nos enseñan aspectos inéditos de la filosofía de los siglos modernos, un viaje en el que la posmodernidad se revela como el penúltimo recurso retórico de un personaje ficticio y casi olvidado. This article analyzes the meaning of the expression "disenchantment of the world" in the French philosopher Marcel Gauchet’s thought. In order to do so, it seeks to show that, through the thesis of an exit of religion, Gauchet presents the historical development of religion in three distinct stages but successive and interrelated each other, that is to say: The religion of the past as the configurator of the original experience of heteronomy in its most absolute form of the so-called primitive (...) societies or without writing; The historic moment of exit from religion as an event of absolute transition from heteronomous hegemony to autonomy hegemony; and,, finally, the current stage as a "post-religion" moment, in which a metamorphosis of religion is seen in personal belief and, thus, to a transformation of the figure of the Beyond or suprasensible, which entails, in turn, different conceptions and figures of transcendence in the contemporary world. In traversing the Gauchetian thought in its historical-analytical arc, the article shows how the French thinker reflects on the conditions of possibility of the religious and religiosity in the present times. David Albert explains why we can typically influence the future but not the past by appealing to an initial low-entropy state of the universe. And he argues that in the rare cases where we can influence the past, we cannot use this influence to knowingly gain future rewards: so it does not constitute control. I introduce an important new case in which Albert's account implies we can not only influence the past but control it: a case where our actions in (...) the present are reliably correlated with several events in the present and past. To deal with such cases, we need to appeal to epistemic conditions on deliberation: being agents requires our decisions being epistemically undetermined at the time we make them. In a world with the past-hypothesis, this implies that deliberation will typically come prior to decision. Once deliberation in this direction is established, correlations towards the past cannot then be exploited for control. To explain why we cannot effectively control the past, we need to appeal to deliberation, whether as part of a defence of Albert's account, or used independently to explain the asymmetry of control. Our present moral traits are unable to provide the level of large-scale co-operation necessary to deal with risks such as nuclear proliferation, drastic climate change and pandemics. In order to survive in an environment with powerful and easily available technologies, some authors claim that we need to improve our moral traits with moral enhancement. But this is prone to produce paradoxical effects, be self-reinforcing and harm personal identity. The risks of moral enhancement require the use of a safety framework; such (...) a framework should guarantee practical robustness to moral uncertainty, empirical adequacy, correct balance between dispositions, preservation of identity, and be sensitive to practical considerations such as emergent social effects. A virtue theory can meet all these desiderata. Possible frameworks incorporate them to variable degrees. The social value orientations framework is one of the most promising candidates. (shrink)

Appellate Court Modifications Extraction consists of, given an Appellate Court decision, identifying the proposed modifications by the upper Court of the lower Court judge’s decision. In this work, we propose a system to extract Appellate Court Modifications for Portuguese. Information extraction for legal texts has been previously addressed using different techniques and for several languages. Our proposal differs from previous work in two ways: our corpus is composed of Brazilian Appellate Court decisions, in which we look for a set of (...) modifications provided by the Court; and to automatically extract the modifications, we use a traditional Machine Learning approach and a Deep Learning approach, both as alternative solutions and as a combined solution. We tackle the Appellate Court Modifications Extraction task, experimenting with a wide variety of methods. In order to train and evaluate the system, we have built the KauaneJunior corpus, using public data disclosed by the Appellate State Court of Rio de Janeiro jurisprudence database. Our best method, which is a Bidirectional Long Short-Term Memory network combined with Conditional Random Fields, obtained an \ score of 94.79%. (shrink)

O estatuto do realismo em Foucault, apesar de elaborado insistentemente, permanece elíptico – em parte graças à sua associação a proposições que poderíamos denominar ficcionalistas. Através dos textos onde Foucault aborda os nexos de pertencimento entre ficção, universalidade e facticidade, o artigo propõe uma leitura não-realista de suas pesquisas, caracterizada pela recusa não do real enquanto objeto, mas de sua evidência ontológica. Inicialmente, trata da apresentação das insuficiências das interpretações que exigem uma ontologia – como a de Paul Veyne –, (...) bem como das que a substituem pela excepcionalidade da criação – como a de Michel de Certeau. Em seguida, detalha a questão da literatura como paradigma metodológico, especialmente nas referências de Foucault à obra de René Char. Enfim, mostra em que sentido a enunciação do discurso da arqueogenealogia está mais próximo do (não-)realismo de Fichte – no seu improvável encontro com Blanchot – do que da dialética hegeliana. A história da relação equívoca entre Nietzsche e Wagner revela as dimensões de sua frágil tensão, se considerada segundo os elementos com base nos quais ambos conceberam o problema da cultura e sua renovação como missão política e teórica. O presente artigo pretende, a partir da leitura de documentos testemunhais, sublinhar a distância ideológica que o filólogo e o compositor, estrategicamente, tiveram de ignorar. Mostram-se, através desta análise, as diferenças normalmente pouco abordadas entre os projetos de reforma da cultura elaborados (...) pelos dois autores – tanto no que se refere à atuação política, quanto no que diz respeito a uma visão de mundo. The objective of this study has been to establish the level of significance that Gustavo Gutierrez and Juan Luis Segundo attribute to politics in their contributions to liberation theology and to extract the relevant consequences for political theory. ;A systematic analysis of the theory of history in the works of these two authors indicates a higher level of integration between Christianity and politics that is usual in Christian political thought. Liberation is equated with salvation and political liberation is seen as (...) one of its components. This brings politics to a position of privilege. When at the service of justice it occupies, for our authors, a high rank among Christian concerns and when devoted to oppression it requires diligent response from every Christian. ;This understanding of politics is valuable in that it accentuates the political aspect of the Christian theory of history, an element frequently underestimated. Certain tensions remain, however, in the theory as a result of this emphasis: between the moral improvement expected from the involvement in political activities conducive to justice and the moral ambiguity of political structures emerging from such activity; and between the use of the concept of class struggle and notions of conversion and reconciliation. Finally, there is the danger of reducing the critical ability of Christians regarding a particular political project by identifying it with the concept of eschatology. (shrink)

El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios desacuerdos acerca (...) de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. At last, I will justify the main elements of the poena naturalis by their best moral light. (shrink)

ResumenEste artículo propone una idea de intervención e institución que se entrelace en lo social a través del concepto de contagio como elemento filosófico articulador. En primer lugar, se establece un marco teórico-filosófico para pensar la vida como una ontología social del contagio, que permita habitar un pensar relacional etológico que se abra a otros modos de existencia. Desde este marco, los hallazgos perfilan la relación intervención-institución desde la sensibilidad que evoca esta forma distinta de intervención en lo social, disponiendo (...) de otros modos las variaciones de la institución y sus procesos de instituir el campo social. Se concluye discutiendo la relación entre intervención y sus capacidades transformativas como componente metódico y epistemológico distinto que trae consigo un fuerte potencial político y ético. Al multiplicar los modos de ser y los procesos de subjetivación se abren prácticas humanas y más-que-humanas, instituyendo otros modos de hacer-y-pensar toda intervención del presente.Palabras clave: institución; intervención; contagio; formas de vida; cartografías. En varios pasajes de la obra de Lévinas vemos que su manera de presentarse frente a lo político es ambigua. O bien, resulta mejor decir que solo en apariencia el "objeto" de lo político en sus reflexiones sobre la justicia y el Estado resultan claras; hay una suerte de equívoco que vale la pena precisar y distinguir. Así, el objetivo central de este trabajo es describir dos momentos políticos en Lévinas leídos en clave Estado, como una figura posible de la (...) política; desentrañamos así la trama anti-política en tanto crítica política al Estado, para llegar a la trama del Estado justo e igualitario, lo que abre nuevas puertas para pensar lo político. A partir de esta descripción reflexionamos, por un lado, una postura crítica frente a las ideas sobre el Estado de Lévinas desde las vinculaciones ético-políticas que hace, tal como la de Alberto Sucasas. Y por otro, en contraposición a éstas, las interesantes y extravagantes lecturas que hace Miguel Abensour de Lévinas creyendo que las relaciones ético-políticas levinasianas aportan a renovar críticamente una nueva figura de Estado dejando el terreno político y estatal abierto a nuevas reflexiones. In several passages of Levinas' work we see that his way of presenting the political front is ambiguous. Or, more precisely, that the "object" of the political in his reflections about justice and the State is only apparently clear; there is a sort of equivocalness that is worth clarifying and distinguishing. The aim of this article is to describe two political moments in Levinas, read in terms of the State as a possible figure in politics. We thus unravel an anti-political theme which is critical of the politics of the State, in order to reach a theme of a State that is just and egalitarian. This opens up new territory from which to think of the political. One critique of Levinas' ideas of the State in terms of its ethical-political linkages is that put forth by Alberto Sucasas. A second contrasting critique is the interesting and extravagant reading of Miguel Abensour, in which Levinasian ethical-political relationships lead to a critical renewal of a new figure of the State, leaving the political and state terrain open to new reflections. Ortega y Gasset’s old lament that no one had so far attempted a rigorous phenomenology of pain no longer holds since the appearance of Christian Grüny’s recent monograph Zerstörte Erfahrung. Eine Phänomenologie des Schmerzes. Grüny argues for the use of phenomenological categories from Merleau-Ponty in order to understand physical pain as a “blocked escape-movement” , concluding that corporeal suffering makes impossible both a clean distinction and a pure identification between the lived body and the physical body that I am. In (...) my paper, I would like to suggest some improvements to Grüny’s approach through the utilization of the category of self-affection, as the material phenomenology of Michel Henry has developed it. In addition to the radical immanence in which hyle, noesis, and noema are unified into a “carnal cogito,” however, I argue that it is necessary to describe the painful self-affection not only in terms of any sensitive excess whatever , as Grüny posits, but also in terms of a mutation of the sensitive excess into the intra-tactile sphere of sensibility. Thus I endorse the Husserlian insight that makes tactility the primordial structure of sensibility. (shrink)

Este artigo discute o conceito de "panóptico digital" e seu papel na sociedade contemporânea. O filósofo Byung-Chul Han introduz a idéia do "panóptico" - inicialmente desenvolvido por Jeremy Bentham no século 18 - para descrever uma forma de controle e vigilância presente na sociedade moderna. São discutidos os efeitos das tecnologias digitais no acompanhamento e controle do comportamento individual, bem como a ameaça que isso representa para a privacidade e a autonomia. Também discute o conceito de "psicopolítica" e como ele (...) está relacionado ao uso das tecnologias digitais para vigilância e controle. Por fim, destaca a importância de proteger a liberdade e a privacidade individual, ao mesmo tempo em que considera os impactos potenciais das tecnologias digitais nas relações sociais. (shrink)

The objective of this work is to reconstruct the concepts of constellation, parataxis and essay, from the perspective of Theodor Adorno, in order to approach them by affinity, but demonstrating the way that each one expresses within its specificities the Adorno’s insistence in a model of thought in which the non-identical: 1) resists conceptual subsumption by arranging itself in a constellatory configuration; 2) it does not succumb to subordinate juxtapositions typical of merely communicative language; and, 3) finds its best philosophical (...) expression in the essay form. In order to do so, we will take as a starting point the adornian reconstruction of the constellation category as a legacy of Walter Benjamin’s thought, so that later we can present the expansion of this category in Adorno’s thought, relating it both to the conception of parataxis as in the conception of the essay form, but aiming to understand these categories as way of thinking philosophically aiming to elucidate the place of the non-identical in the scope of dialectical thinking of Theodor Adorno. This article intent to bring some notes to understand the role of religion in the work of Slavoj Žižek. Is quite clear that religion is a big problem that Žižek faces in some of his book and to us is quite clear that his concern about this theme is extremely important to his view on politics and psychoanalysis. This article points out some insights about the main themes that Žižek works in his book about religion. We have no intent to (...) encompass all the repercussion of Žižek’s thought about religion, but we believe that this article opens a good aproximation to the theme of religion in Zizek’s work. Observational studies have suggested that some nonhuman primates’ cooperative behavior may rely on their capacity to share goals and understand the role of their partners. Experimental studies have tried to find evidence for this under controlled conditions, investigating aspects like the degree of organization in different primate species and the individuals’ capacity to recognize and choose good partners, switch roles with them, and care about their outcomes. Often, the results have been mixed. Partly, this is because of the methodological difficulties (...) inherent to empirical research. In this paper, I offer a critical, methodological review of the experimental studies done in the last years on nonhuman primates’ cooperation, I discuss their findings, and suggest possible solutions to some of the procedural problems. Hopefully, this will contribute to improve the design of future studies and therefore our knowledge about the evolutionary history of cooperation. (shrink)

A new argument has been made against moral enhancement by authors who are otherwise in favour of human enhancement. Additionally, they share the same evolutionary toolkit for analysing human traits as well as the belief that our current morality is unfit to deal with modern problems, such as climate change and nuclear proliferation. The argument is put forward by Buchanan and Powell and states that other paths to moral progress are enough to deal with these problems. Given the likely costs (...) and risks involved with developing moral enhancement, this argument implies moral enhancement is an unpromising enterprise. After mentioning proposed solutions to such modern problems, I will argue that moral enhancement would help implement any of them. I will then detail Buchanan and Powell’s new argument disfavouring moral enhancement and argue that it makes too bold assumptions about the efficacy of traditional moral progress. For instance, it overlooks how that progress was to achieve even in relatively successful cases such as the abolition of slavery. Traditional moral progress is likely to require assistance from non-traditional means in order to face new challenges. (shrink)

This article aims to present how the philosopher Emmanuel Lévinas understands the issues of suffering and evil in the world, hardships frequently considered as obstacles to the belief in God. Breaking away from the logic of theodicies, the French-Lithuanian philosopher developed original and instigating perspectives on these themes, placing them in an eminently ethical domain. It concerns an ethic that escapes reciprocity, in a context of asymmetry, with the granting of absolute priority to the other man. Such reflections are particularly (...) relevant in the dramatic scenario established by the Covid-19 pandemic, which has given rise to suffering, death, and several uncertainties, among which the narrative of God. The new coronavirus has sparked a crisis of global dimensions, which raises the need for a new civilizational paradigm, prioritizing principles such as cooperation, human solidarity and ethical responsibility towards others, a horizon in which Lévinas' conceptions are included. The theme of the other (autrui) in Deleuze is confused with the double task of articulating a new perspective of the sense while questioning the traditional image of thought. This opens up ground from which to analyze this theme in the work of Deleuze which although is systematically visible in Différence et répétition (1968) and Logique du sens (1969) some elements of are discernable in Proust et les signes (1964). This study addresses the idea that the territory of the other (...) is the sense as identified in these three texts. Further ideas will also be introduced that center on the face and the manner in which it reformulates ties to sense. As suggested in Deleuze, a type of thinking is installed in the opening to the other, however not necessarily entering into the registry of morality nor of knowledge. (shrink)
